A Kiowa property owner identified as Joey told the Board of Trustees that a bank building he purchased cannot house a daycare because the town's table of permitted uses is restrictive and has few allowable uses for Town Center.
"My biggest concern is I'm seeing very little on this chart. This shows I can actually do much of anything," Joey said, describing limits that list bed‑and‑breakfasts, churches, parking lots, certain medical caregiver operations, restaurants and retail as the primary permitted uses.
Joey said bars, car lots and gas stations are not allowed under the new Town Center rules and asked whether existing operations would be grandfathered so a future owner could continue to run a tavern or gas station. He said uncertainty over grandfathering could significantly affect property values and asked the board to clarify whether existing businesses retain their permissions when ownership changes.
Trustees and staff acknowledged the question and said they would review the code and provide clarification. One trustee noted that the minutes from a prior meeting had modest edits (mainly changes of names) and that earlier actions modified references from "city" to "town," but no immediate zoning decision was made at this meeting.
Next steps: staff agreed to clarify how the comprehensive plan updates and zoning amendments affect existing businesses and whether nonconforming uses would continue to be permitted after a sale.
