Peabody conservation staff issue enforcement orders at three sites after site visits; commission ratifies orders
Summary
Following multiple site inspections, staff recommended—and the commission voted to issue—enforcement orders for illegal fill, buried root flares and poor erosion controls at 26 Tras Road, 31 Pont Street and 147 Summit Street (Pinto Recycling), directing cleanup, erosion-control installation and further filings or after-the-fact NOIs.
The Peabody Conservation Commission on June 10 authorized enforcement action after staff documented unpermitted work at several sites and described correction steps for each.
26 Tras Road: Staff reported removal of unauthorized fill from a previously filled wetland/buffer area and an existing canopy/ shed partially located on a neighbor's lot. The property owner (represented by LEC) intends to pursue either an after-the-fact RDA or a notice of intent depending on zoning board outcomes; the commission asked for corrected erosion-control placement, clarified the need to resolve property-line encroachments and continued the matter to a July meeting to allow the owner time to file a formal application.
31 Pont Street: Staff recorded placement of fill and construction of a concrete block wall near the riverfront and FEMA floodplain, removal of trees and other unpermitted alterations. The owner informed staff she planned to hire an engineer to produce a remediation/construction plan and an after-the-fact NOI; the commission set a September deadline for a filing so staff could review engineered options for mitigation and safe wall/grade stabilization.
147 Summit Street (Pinto Recycling): A staff inspection found crushed wrapping material and debris stored near or in public resource areas, trunk flares buried under fill, and insufficient erosion controls. Staff reported that property owners and operators were cooperative, had removed loose debris and agreed to corrective measures. The conservation agent prepared two enforcement orders: one directing Pinto Recycling to remove wrap, undo buried stump material and install erosion controls; the second requiring removal of material placed beyond the permitted work area. The commission voted to issue the two enforcement orders (vote 4'to—0) and staff will circulate drafts to commissioners before formal issuance and next steps.
Commissioner and staff notes
Lucia Delenegro, the conservation agent, told the commission that most operators were cooperative and willing to work with staff to remediate the sites. "Everyone was very willing to work with us," she said, and urged owners to bring engineered remediation plans when significant bank work or wall removal is proposed.
What owners must do
For all three cases, the commission required either an after-the-fact filing (RDA or NOI) with an engineer-prepared construction sequence or specific remediation steps; in the Pinto case the commission authorized immediate enforcement orders to hasten cleanup and installation of erosion controls. Staff will monitor compliance and bring any noncompliance back to the commission for further action.
