Zoning board approves variance for property with unpermitted pool and shed

The Zoning Board of Adjustment voted unanimously to approve a variance for Christopher George, whose existing pool and shed encroach on the rear property line.
Christopher George, the applicant, told the board he discovered the pool had been installed “about 20 years ago” without permits and is “about seven foot two” from the property line, short of the required 10‑foot setback. He also said the shed, installed in 2022, sits on the property line but is in good condition.
Board members and staff discussed conditions to avoid future nonconformities. Jonathan (staff member) recommended the board require an agreement with the buyer that any replaced pool or shed be relocated to a conforming location. Chairman Cahill and other members agreed to include that condition in the approval.
No members of the public spoke on the application. A motion to approve the variance with the conditions discussed passed on a roll‑call vote; Mr. Weisman, Mr. Tillery, Mr. Patel, Mr. O'Reggio and Chairman Cahill all voted yes. The board will memorialize the approval in a written document and mail it to the applicant.
The board noted it will set the conditions in the memorializing resolution and that the applicant need not be present at the next meeting when the written memorialization is prepared.
