Final plat for Courtyards at Haines Creek approved after neighbors raise grading and easement concerns

The New Albany Planning Commission voted Nov. 18 to approve Final Plat 85 for phase one of the Courtyards at Haines Creek subdivision, subject to staff conditions and an additional requirement that the plat include a note directing viewers to the zoning text for any additional restrictions such as setbacks.
Planning staff said the phase includes 46 residential lots, six reserves and seven streets, and that a previously reported one-acre open-space deficit had been reduced to one-tenth of an acre after redesigning stormwater basins. "When we went through the final engineering... we actually are only one-tenth of an acre in deficit now," the applicant's representative said.
During public comment, nearby property owners expressed concern about grading, elevation changes and drainage. Tamara Davies, who owns property adjacent to the project, told the commission that the project’s grading plans would raise the western edge near her property by an estimated 7–8 feet and asked when and where a master grading plan is reviewed. "They're planning on raising my the whole side to the west... 7 to 8 feet above what's currently there," she said, asking for clearer timing and review criteria.
City engineering staff said grading plans are reviewed and approved administratively as part of the final development plan and that draft plans had been submitted; the applicant confirmed it would submit required engineering reviews and county engineer comments and had placed floodplain panel references on the plat.
Another commenter, Ron Davies, asked that setback and easement information be placed directly on the plat to avoid future confusion; staff agreed to add a note pointing readers to the zoning text and discussed existing protection zones on the western property line.
Following discussion, the commission admitted the final-plat documents into the record and approved the plat with the staff-recommended conditions and the additional plat note to reference zoning text for setbacks and other restrictions.
