Council adopts Resolution 2026-3, reducing utility late fee from 15% to 10%

Recorder Corey Twedt presented edits to the Water User Rate Resolution at the May 14 council meeting following benchmarking by Treasurer Megan Dyer, who reported that Millville's 15% late fee was higher than many comparable Utah cities. Staff recommended reducing the late fee to 10% and made several minor corrections to the resolution's redline draft.
Councilmember Darcy Ripplinger said a 10% late fee seemed appropriate; Councilmember Jeremy Ward raised the option of a fixed-fee late charge versus a percentage but council consensus favored keeping a percentage-based late fee. After discussion, Councilmember Pamela June moved to adopt Resolution 2026-3 and Councilmember Jacob Ames seconded. Councilmembers Ward, Ames, June, Ripplinger and Zollinger voted yes and the resolution was adopted.
The adopted resolution reduces the late fee to 10% and incorporates the minor edits shown on staff's redline document. The council asked staff to implement the change and to continue monitoring comparative practices among other Utah cities. The resolution was entered into the meeting record as Attachment "C."
