Council asks attorney to draft waiver for nonprofit developer-agreement bonding after museum example discussed

Talbot County planning staff and the planning commission asked the council on June 9 to direct the county attorney to draft a zoning text amendment that would allow the county to grant limited waivers of developer-agreement performance-bond requirements for bona fide nonprofit projects where the waiver is in the public interest.
Brennan Tarlton, planning director, said the proposal would amend a code section so the planning director — on recommendation of the planning commission — could consider waivers for bona fide nonprofits. The council discussed the example of the Belleview Passage Museum, where the nonprofit proffered park improvements that would be inspected and accepted by the county at turnover; the bonding requirement created financial obstacles for the nonprofit’s funding mix.
Council members emphasized the amendment would not grant automatic relief; the planning commission would still review waiver requests and could deny them if standards in code section 190‑62 were not met. The council asked the county attorney to prepare draft language for introduction at a future meeting.
