County attorney Ormsby told the council that the library published a newspaper notice on Dec. 24, 2025 and scheduled a Jan. 8 public hearing on the bond issuance and appropriation. Ormsby said the DLGF (Department of Local Government Finance) online "gateway" was not available early enough to permit the library to upload the notice more than 14 days before the Jan. 8 hearing, and "the library did not upload the notice to Gateway for the January hearing prior to the January 8 date," as a result of the gateway's limited availability. DLGF later requested a corrected upload and on posting accepted the January resolution and appropriation without reduction, Ormsby said.
"This is a quasi-legislative matter," Ormsby told the council, summarizing the legal standard: courts generally will not overturn discretionary local decisions except in cases of fraud or criminal malfeasance, and the council retains discretion to reaffirm or revoke a prior discretionary approval before bonds are issued. He cited state statutory provisions referenced in the report (Indiana Code 6-1.1-17-20.5; Indiana Code 6-1.1-18-5) as the governing notice and appropriation authorities.
Council member Kimberly moved "to approve to reaffirm that the library has satisfied all of the legal requirements as determined by the DLGF," and Kathy seconded the motion. Supporters said the deputy director's later acceptance of the filing and the DLGF's posted order supported reaffirmation. Opponents said the decision felt political and urged caution about the long-term tax implications, with one member saying, "I don't feel that it's a wise decision to make moves and to invest millions of dollars until we know the impacts of policy down at state, after this next session." Library representatives said the project is already under significant expense (the library reported approximately $480,000 of costs already incurred) and that bond proceeds and debt service would be borne by Syracuse/Turkey Creek Township taxpayers rather than the county general fund.
The council called for a voice vote and indicated the motion to reaffirm carried; the transcript does not record a numeric roll-call tally for the reaffirmation vote. The council also noted that it retains authority to revoke or revisit the January resolution prior to bond issuance should legal circumstances later require it.
Ormsby's written findings and the DLGF email exchanges were presented at the meeting as the factual basis for the council's procedural decision. The council concluded the matter as a procedural vote and closed public comment on the item for that night.
