The Linton City Council voted to table Ordinance 2026-04, an update to rules governing park fundraisers and shelter-house use, after members said they needed legal clarification about which local body holds approval authority.
Councilors raised concerns that Indiana Code sections cited in the draft (36-10-3-10 and 36-10-3-11) assign authority over park and recreation matters to a statutory park and recreation board, not the mayor. Several council members said the city currently has a park advisory board rather than a statutory park board and that converting or dissolving a statutory board would require formal action by the city’s legislative body. Council members requested that city attorneys verify the board’s legal status before the ordinance is considered further.
Because of the unresolved question about which entity may approve events, a motion to table Ordinance 2026-04 was made, seconded and approved by voice vote. Councilors agreed the existing ordinance (2026-01) would remain in effect until the legal question is resolved.
The item will return to the agenda after staff and the city attorney report back with the legal determination and any suggested ordinance edits.
