Ridgeway planning board approves assignment of permits for 2800 Swett Road solar project to developer affiliate

The Town of Ridgeway Planning Board voted Feb. 3 to approve transferring permits and obligations for the solar energy project at 2800 Swett Road from DG New York CS, LLC to its affiliate, DG New York CS II, LLC.
Chairman Tom Fenton opened the meeting and the board adopted a resolution that assigns the Special Use Permit and related site approvals to the affiliate and authorizes town staff to consider any further approvals, including building permits, submitted by DG New York CS II, LLC. The resolution lists documents the assignee will assume, including the Project Operations and Maintenance Manual (last revised June 25, 2020), the Project Decommissioning Plan (last revised Sept. 3, 2020), the Stormwater Pollution Prevention Plan (last revised Sept. 2020) and the Project Landscaping Plan as revised Dec. 2, 2020.
Member Kathy Blackburn moved to adopt the resolution; Tim Elliott seconded. The motion carried with four ayes (Tom Fenton, Tim Elliott, Kathy Blackburn and Thomas Kline) and one abstention (Richard Fisher). The resolution took effect immediately.
Dan Wolfe, the town's code enforcement officer, told the board he received a call from resident Andrew Marciniak alleging that workers on the Swett Road project had trespassed on his property. Wolfe said he would inspect the site and recommended that Mr. Marciniak contact the Sheriff's department if trespassing continues. No further enforcement action was recorded in the minutes.
The board also noted that final decision letters had been signed for the Medina Solar Project sites at 11074 and 11202 Ridge Road, approving those Special Use Permits with previously stated conditions. The meeting adjourned at 7:25 p.m.; the next meeting was scheduled for March 3, 2021.
