The Plan Commission voted June 8 to recommend vacation of an unimproved portion of South Chestnut Avenue at the Art Street intersection, a parcel the redevelopment authority and adjacent property owners have petitioned to have split and reassigned to adjoining owners.
Staff said the right‑of‑way has functioned as part of private parcels for years and described agreements already negotiated for access and cross‑building easements between the redevelopment authority and Trinity Evangelical Lutheran Church. Staff recommended approval conditioned on preserving an existing access easement to a tower and updating ownership language after the split.
Alder Jim Hutchinson moved the commission recommendation and Commissioner Full Wilder seconded. The commission approved the vacation and forwarded the resolution to City Council; staff noted that state law requires a 40‑day period between introduction at council and final reading, which places final action later in the summer.
The recommendation directs staff to include the access‑easement condition and to update ownership language in the council resolution packet.
