Montville planning board approves 'area in need of redevelopment' study for Diversified properties

Montville Township Planning Board voted unanimously April 23, 2026, to approve an Area in Need of Redevelopment study for a collection of Diversified Properties parcels on Main Road, Daldunn Road and River Road and to forward the recommendation to the township governing body for consideration.
J. Burgis, the township planner, presented a study dated April 1, 2026, covering the study area identified as Block 59, Lots 13, 15, 17, 18, 19, 20 and 22. Burgis reviewed the study’s title, background, litigation history, reference to LRHL statutory criteria, maps, environmental constraints, and the relationship to the Master Plan and existing zoning. He said the study included which individual lots met or did not meet specific statutory criteria and summarized next steps: Planning Board recommendation, governing-body adoption, and, if adopted, authorization to prepare a redevelopment plan.
Board members questioned aspects of the study, including the decision not to apply criterion H for one or more parcels and whether specific redevelopment proposals would follow once the area was designated. No members of the public spoke during the hearing.
Dr. Kornreich moved to approve the Area in Need of Redevelopment finding; Mr. Hines seconded the motion. The board approved the recommendation by roll-call vote with all five members present voting in favor (P. Repic, L. Kornreich, L. Hines, S. Failla and R. Lipari).
The board also adopted a separate non-condemnation resolution related to 17 Chapin Road, again on a unanimous vote. The planner said the governing body’s adoption is the next formal step; if adopted by the governing body, that body may authorize preparation of a redevelopment plan that would contain specific zoning or redevelopment controls.
The planner noted in his presentation that a judge-ordered settlement exists between the township and Diversified; Burgis described that settlement as background to the need for the study but did not specify terms. The board did not take further substantive action to authorize or approve a redevelopment plan at the meeting.
The board adjourned at 7:55 p.m.
