The West Allis Planning Commission voted to approve a conditional use for a paleteria (popsicle shop) proposed at 5900 West Burnham, allowing on-site food production for both retail and wholesale distribution.
A staff member told the commission the property, at 59th and Burnham, has been vacant since 1955, is zoned C2 and requires a conditional use for the planned food-production activity. Staff described the proposed hours as retail operation from 12:00 p.m. to 12:00 a.m. and food production beginning at 7:00 a.m. seven days a week. The site plan shows no changes to existing exterior building materials, potential patio seating along 59th Street or Allis Chalmers Street, a bike rack in the right-of-way and an existing refuse area at the north of the property. Staff said sign and lighting plans will return for separate approvals and any work in the right-of-way will require permits.
Lisa Sullivan of Milwaukee County, who identified herself as supporting small businesses, described a county program that connected the applicant with an architect. A commissioner moved to approve the conditional use and the motion received a second; the commission carried the motion by voice vote.
The applicant, identified in the meeting as the presenter and the property owner, said she had searched for a location for two to three years and was "happy to...open this business here in West Allis," calling the building "very historic." She told commissioners there is no intention to serve alcohol and that the interior plan includes seating, a counter bar, a small stage for performances and an upstairs residential unit that will remain separate from the business.
Staff recommended Common Council approval subject to the conditions discussed at the meeting, notably required permits for any right-of-way work and future sign and lighting approvals. The commission’s vote allows the applicant to pursue construction bids and finalize plans before returning for any additional approvals required by the city or the Common Council.
Motion and outcome: The commission moved and seconded the conditional-use approval for the paleteria; the motion carried by voice vote.
