Bolton commission presses on enforcement at 37 Notch Road after no response from property representative

Bolton Wetlands Agent Alyssa Barroso told the Inland Wetlands Commission Jan. 27 that a Cease-and-Correct notice remains unresolved for debris in wetlands at 37 Notch Road, associated with property owner Alexey Ouzonov, and that the commission is prepared to reissue the violation or pursue court action if the parties do not respond.
Barroso said she has had no response from the site's wetland scientist, George Logan, and that she emailed the owner but received no contact. Planning & Zoning has walked the site and issued a notice of violation; the transcript records a 30-day response period. Chair Ross Lally said he has not heard back from J. Rupert or the Town Attorney and noted the commission has received additional complaints about the property; he and other members discussed reissuing the violation and the possibility of seeking a court order. Barroso also said the property received an agricultural exemption many years ago.
The commission also discussed lost files following a records transfer with an external vendor (the transcript alternately references that vendor as “Novis” and “Noves”); R. Lally said he will contact the vendor and Barroso will draft a plan to recover the lost files and work with Barbara Kelly to locate records.
No formal enforcement vote was recorded in the transcript on Jan. 27; commissioners indicated they will pursue reissuing the violation and may escalate to court action if there is no compliance.
