Residents push for enforcement as commission orders cease-and-desist and keeps runoff complaints on the agenda

The Conservation Commission took two enforcement-related steps after extended public comment from abutters who described unpermitted tree clearing, loss of wildlife habitat and ongoing drainage problems.

On a property tied to recent solar development activity, several neighbors said trees were cut before permits were final, that promised plantings were not installed and that the work has reduced wildlife sightings. One resident, Deborah Perry, told the commission the stream “runs right up against my house” and that contractors had removed trees and filled land without adequate oversight. After hearing testimony and staff updates, commissioners approved a motion to send a certified cease-and-desist notice to the property owner and directed staff to include a temporary prohibition on lawn fertilizing and other activities in the buffer while investigations proceed.

Separately, neighbors renewed complaints about runoff from 185 Matapoit Road, where work subject to an amended order remains unresolved. Resident James Suza told the commission he had experienced 17 months of ongoing flooding onto his property and expressed frustration that listing the property for sale could delay remediation. Commissioners agreed they lacked immediate unilateral enforcement authority beyond their orders and said they would consult town counsel and state DEP guidance and keep the item on future agendas.

Commission staff said they will follow up with town counsel about possible civil remedies and will continue to track peer-review and compliance steps. The commission also urged residents to keep documenting conditions and to contact the agent with evidence if they observe further work on sites subject to orders.

Next steps: staff to issue the certified cease-and-desist and consult town counsel; commission to revisit 185 Matapoit Road and report any response from the property owner at the next meeting.
