Foster County Water Resource Board approves subsurface water permit with conditions; manager abstains

The Foster County Water Resource Board approved a Subsurface Water Management System Permit application for applicant Van Bedaf at its May 27, 2026 special meeting in Carrington.
Ronn Stangeland moved to approve Subsurface Water Management System Permit Application No. 20260003, and Alex Stedman seconded the motion. The board voted "all in favor," with Manager Doug Zink abstaining. The motion carried.
The approval was conditioned on multiple requirements: installation and maintenance of proper erosion control at all outlets; re-establishment of disturbed areas to their previous condition; obtaining a permit amendment for any alterations to outlet locations, new outlets, or improvements that would drain additional acres; and ensuring there is grade from the outlet lift pump to the natural watercourse in the SE1/4 of Section 34-146-66 so flow follows the Flow Direction Map submitted with the application. The minutes note that if grading is necessary within the road right-of-way west of 70th Ave. NE to satisfy the grade condition, it is the permittee’s responsibility to secure permission from the applicable road authority and underlying landowner.
The board directed Rinke Noonan law firm to send the notice of decision to the DWR and to Maurice & Virginia, LLP. The minutes do not record further administrative deadlines or appeal instructions for the permit.
The board also recorded that no members voiced opposition to a separate application for appropriation of groundwater that was distributed for review during the meeting. The next Foster County Water Resource Board meeting is scheduled for June 10, 2026, in the basement Board Room at the Foster County Courthouse.
