Attorney Brian McGra told the Wakefield Planning Board on June 9 that the owner of the properties at 154 and 158 Salem Street is preparing documents to record the subdivision and begin construction this summer. He said the owner plans to merge the two lots into a single entity, Wakefield Salem Street LLC, and record that deed first.
McGra said the applicant has drafted supplemental covenants and will initially secure the subdivision with a Form G covenant that prevents sales or building on lots until the planning board releases it. He said a private mortgage exists on the property and that the applicant will provide evidence showing the covenants are subordinated appropriately so the town’s rights would be preserved in a foreclosure.
McGra told the board the town engineer calculated an I&I (inflow and infiltration) fee of $20,700, and the engineering office confirmed that figure. He said the fee must be paid and that he will provide confirmation of payment by email from the town engineer before the planning board endorses the mylar plan. He also noted that the mylar must be signed by the town clerk on every sheet prior to endorsement so the registry of deeds will accept it.
Board members asked procedural questions about documentation and plan numbering. Jim Hogan confirmed he found the stormwater report and the O&M plan referenced in that report; Bill Spalding and others discussed clarifying the restrictive/landscape covenant by noting the full set of plan sheets (for example, inserting the sheet count to avoid ambiguity). McGra said he would add clarifying language as needed and coordinate delivery of two endorsed mylars (one for the board and one for the engineering department).
No formal board vote was required to proceed with signatures; McGra said he will provide payment evidence, the deed merging the properties into Wakefield Salem Street LLC, and the finalized mylar for the chair’s signature within days. The chair and staff will then circulate the mylar for endorsement.
