Park Spirit presses city for documentation on historic parkland transfers and legal authority

Karen Miller, an officer of Park Spirit, asked the Parks and Recreation Commission to use its authority to investigate historic transfers of parkland used for non-park purposes and to press the city solicitor’s office for documentary evidence.

Miller said the group received responses to its public-record requests that did not include signed copies or the open-court references cited in a 1960 Supreme Judicial Court decree. “They actually provided back the unsigned copy of that decree and not the signed copy that shows that it was valid,” she said, and added the judge’s name on the unsigned document was misspelled.

Miller also cited Chapter 154 of the Acts of 1882 and argued the commission should be able to use that statute to prevent further permanent transfers of parkland for school or other non-park uses. She asked the law department to verify the city’s record and to supply any signed decrees or transfer documentation the city claims to possess.

City staff recommended filing agenda items 7B and 7C and moving 8B to old business while staff follows up; commissioners voted to file and to request the law department provide the missing records at a future meeting. Commissioners signaled interest in ensuring clarity about Elm Park acreage and any historic surplus transfers that removed land from park status.

Park Spirit’s request raised procedural and documentary questions the commission asked the administration and the city solicitor to resolve before any formal policy or transfer decisions are taken.
