Workforce Commission adopts rule changes, approves TYRA apprenticeship rule, RESA payout and board nominees

Reed O'Brien, Office of General Counsel, presented a final rule to amend 40 Texas Administrative Code Chapter 800 by creating subchapter E to set abolishment dates for three TWC advisory committees (the Industry-Based Certifications Advisory Council, the Jobs and Education for Texans Advisory Committee, and the Lone Star Workforce of the Future Advisory Board). The proposed abolishment date for each committee is December 31, 2035; the commission adopted the amendments after a 30‑day notice period that produced no comments.
O'Brien also presented the proposed repeal of Subchapter J of 40 TAC Chapter 806 (purchases from people with disabilities) following expiration of the enabling statute; staff noted the underlying minimum-wage enforcement remains in effect through other statutes and reporting mechanisms, and the commission adopted the repeal.
On Chapter 838, staff recommended adopting final amendments implementing House Bill 3260 to expand TWC authority under the Texas Industry-Recognized Apprenticeship (TYRA) grant program. The rulemaking responds to statutory changes that increase flexibility to recognize apprenticipable occupations and certify industry-recognized apprenticeship programs; commissioners adopted the rule.
Separately, Susette Robinson, Workforce Development Division, reported that the RESA reemployment program earned a FY2025 performance outcome payment. Staff recommended amending board contracts for contract year 2026 to distribute $318,441 of the FY2025 payment to boards per the distribution table in the discussion paper; commissioners approved the amendment and distribution.
Cara Levy presented Workforce Solutions Heart of Texas local board nominees; commissioners moved and approved the nominees.
Each adoption was accompanied by a motion, a second and a recorded "motion passes" in the transcript. Staff requested authority to make non‑substantive edits required by the Texas Register and Secretary of State publication processes, which commissioners authorized.
The meeting then concluded with a motion to adjourn.
