Planning board declines reallotment for 7840 Yager Road; applicant advised to seek ZBA variance

Jeffrey Moore, representing applicant Virginia Migon, told the board he had been unable to submit and pay for the reallotment application earlier because the Town Clerk's Office was closed on June 19. The board reviewed the draft plat and determined it did not satisfy the Zoning Law standard that a lot provide one-quarter of the original frontage or at least 200 feet, whichever is greater.
The board recorded that it could not approve the reallotment as drawn and advised Moore and the applicant to file the reallotment with the Town Clerk as soon as possible and to pursue an area variance from the Zoning Board of Appeals (ZBA). The minutes note the ZBA is scheduled to meet on June 30, 2025.
Board members emphasized the procedural requirement that an applicant receive a denial or nonapproval before seeking a ZBA variance for frontage. The Planning Board's determination in this meeting was made from a review of the draft application and plat; the board did not take a roll-call motion with a recorded poll vote for final denial in the minutes.
Next steps: Moore will submit the reallotment application to the Town Clerk and attach a copy of these minutes and the preliminary plat when filing for a ZBA variance.
