The Woodbury County Board of Supervisors voted 5‑0 to grant an embargo exemption to Hogan Construction so the contractor and its subcontractors may use portions of 220th Street up to address 1360 while a six‑ton embargo remains in effect.
Attorney John Hines presented the request on behalf of property owner Wes Hunold, explaining the owner has an open building permit and no practical alternative access for heavy equipment. Contractor Nick Hogan described the time sensitivity for the project and the need to bring in concrete trucks, pumps and other heavy vehicles or risk layoffs.
County staff explained the county currently issues overweight/hauling permits on a vehicle‑by‑vehicle basis and raised enforcement concerns if a broad exemption were allowed. Staff also said the embargo is scheduled to end August 4 and described potential road remedies (returning the section to rock, lowering speed limits) to make the corridor more resilient to heavy equipment in the long term.
After lengthy discussion about enforcement, liability, the road’s construction history and mitigation measures, the board reached consensus to allow a blanket exemption for Hogan Construction (to include subcontractors) limited to the 220th Street segment up to 1360 and subject to coordination with county road staff. The motion was made by Nelson and seconded by Bittinger; the board approved it unanimously.
