The New Albany City Council unanimously adopted Ordinance 002‑2026 on Jan. 20, 2026, authorizing the appropriation of 0.8 acres of property from Hendren 1 LLC for public right‑of‑way to support the Green Chapel Road improvement project and declaring an emergency to waive the 30‑day referendum period.
Presenting staff explained the ordinance authorizes right‑of‑way acquisition necessary to keep the Green Chapel Road improvements on schedule and noted the city plans to put the project out for bid on March 1, 2026, with construction targeted to begin in April or early May. Staff also said negotiations and standard due diligence with the property owner will continue even after passage.
Council moved, seconded and adopted the ordinance by a 7‑0 vote.
The measure includes emergency language intended to preserve project timing by waiving the standard referendum period. Staff said they will continue negotiations with the property owner and finalize acquisition details as part of preparing the bid package.
