Conservation Commission issues negative determination for 15 Eagle Head Road porch

The Manchester-by-the-Sea Conservation Commission voted unanimously June 9 to issue a Negative Determination for a Request for Determination of Applicability filed for 15 Eagle Head Road, allowing the applicant to proceed with a covered front porch within the 100-foot buffer to a vegetated wetland.
Applicant Marian Mucle told the commission she plans to replace the front entry with a covered porch spanning the house front; the new porch would place portions of the structure between roughly 93 and 95 feet from the adjacent wetlands and add about 170 square feet of new impervious surface. "It is within at different points within 93 and 95 ft of the wetlands," Marian said in presenting the plan, and confirmed the finished porch floor would be six feet wide.
Commissioners questioned the scope of excavation and drainage. Staff and the applicant described six poured footings about 10 inches in diameter and 48 inches deep to support columns, and said the porch will be roofed with decking beneath. The commission asked whether runoff would be handled with gutters or a French-drain approach; Marian said gutters already exist on the main roof and that runoff from the extra three to four feet of new roof is expected to be small.
After discussion, a commissioner moved to issue a Negative Determination under the state Wetlands Protection Act and the local wetlands bylaw (negative 3 and 6), the motion was seconded and the roll-call vote was unanimous. Chair Steve Gang clarified the outcome: "A negative in this case is good news; that says that we don't think there's a risk of significant impact to the resources and you should go ahead." Staff said the written determination would be forwarded to the applicant the following week.
Next steps: the applicant will receive the written determination and may proceed as described, subject to any conditions listed in the determination. The commission recorded the permitting action and will file its determination under the local records for the project.
