Mead trustees approve first reading of updated building codes after debate over enforcement authority

The ordinance passed by roll call, 5'in favor and 1'opposed; two trustees were absent or disconnected at the vote.
The vote follows more than an hour of technical briefing and a prolonged trustee exchange about language in the town's violations section that gives directive authority to the building official. Trustee Jesse Hagen urged changes after describing a prior episode in which his project was stopped. "We were basically shut down for 6 months on our project due to a claim of violation," Hagen said, arguing that the current language gives a single official too much unilateral power and leaves property owners exposed to protracted legal risk.
Town staff and the town attorney responded that much of the violations language tracks model code text and that the board's action tonight is a first reading; the ordinance requires a second reading and a public hearing before final adoption. Marcus, the town attorney, told trustees staff would review whether additional internal review steps or appeal safeguards could be added before the board's Nov. 10 second reading.
Why it matters: Adopting the 2024 code package aligns Mead with current national technical standards and the state's Colorado model electric/solar-ready requirements. Trustee concerns centered on process and enforcement, not the technical content, and now return to the board for possible amendment at second reading.
What passed: The motion (as read at the meeting) approved Ordinance 1092 "repealing and replacing articles 1 through 10 of chapter 18 of the Mead Municipal Code and adopting by reference the 2024 International Building Code, the 2024 International Residential Code, the 2024 International Mechanical Code, the 2024 International Fuel Gas Code, the 2024 International Plumbing Code, the 2024 International Energy Code, the 2024 International Property Maintenance Code, the 2024 International Existing Building Code, the 2024 International Swimming Pool and Spa Code and providing penalties for code violations." The board set second reading and a public hearing for Nov. 10, 2025.
Vote record (roll call): Trusty Adams — yes; Trusty Cartwright — yes; Trusty Hagen — no; Mayor Prom Harris — yes; Mayor Whitlo — yes. Trusty Crane and Trusty Shr were disconnected earlier and recorded as absent for the vote.
Next steps: Staff said it will return to the board with suggested language or procedures to address Trustee Hagen's concerns, including whether a formalized appeal or an independent hearing officer process can be added without undermining the building official's ability to enforce health and safety standards. The second reading and public hearing are scheduled for Nov. 10, 2025.
