Pembroke board approves MCWA frontage easement as water and sewer projects advance

The Pembroke Town Board on Sept. 25 approved a motion consenting to the Monroe County Water Authority’s acquisition of a frontage easement at 404 Main Road as part of ongoing town water projects.
Supervisor Thomas Schneider said the contractor for the new highway garage plans to turn the building over on Nov. 5 and reported continued coordination on water and sewer connections. The board also heard detailed updates on Water District #5 and Water District #4 reviews with state and federal agencies and on related grant work.
Why it matters: The easement approval is required under §1096(6-a) of New York’s Public Authorities Law for the Authority to proceed with operation and maintenance of the water main that will serve 404 Main Road. Board members said completing paperwork and agency reviews is necessary before construction and connection work proceed.
“They will be working on the water and sewer connections back to the building on October 5th,” Schneider said. He also acknowledged public impatience: “Residents in attendance were frustrated that the water project has taken this long. The town is trying to get things done as quick as possible but we also want to make sure we dot all I’s and cross all T’s so that nothing gets denied.”
Board materials and the discussion showed several agency interactions: the Monroe County Water Authority returned executed Permanent Easements for filing with the Genesee County Clerk; the NYS Department of Environmental Conservation noted wetland and creek-crossing concerns related to horizontal directional drilling; Genesee County Health Department (GCHD) and the New York State Department of Health/Environmental Facilities Corporation were updated about a change in pipe diameter intended to address water-quality concerns; and the U.S. Department of Agriculture had closed the Historic Preservation portion of its review on Sept. 10 for lack of response.
The board report listed four remaining unsent or unsigned easements: ownership/response issues remain with Parks Trust, a revised packet for Duttweiler was emailed Sept. 2, and Jackson had not responded. The board asked the engineering team for a formal Engineering Amendment to document the diameter and scope modifications discussed in e-mail correspondence.
The motion approving the easement (Resolution #62) was made by Councilman Edward G. Arnold Jr. and seconded by Supervisor Schneider and carried 4–0. The resolution directs that a copy be provided to the Authority.
Next steps: With easement approval in hand, town and Authority project staff will proceed with required filings and construction coordination. Outstanding easements and any remaining agency comments must be resolved before final construction activities and service connections are complete.
