Morgan Council approves three improvement lien agreements for adjacent development parcels

The Morgan City Council on June 9 approved three separate improvement lien agreements that record the city's up-front costs for stormwater, sewer and water work as liens against three adjacent parcels so the developer will pay those costs when each parcel is developed.
Ty, a city staff member, explained the background: while the plaza and road were built the city upsized stormwater chambers and installed sewer and water infrastructure to serve nearby vacant parcels. Rather than require each property owner to build separate storm facilities, staff documented the city's expense and recorded a lien against each parcel so the developer will repay the city's costs at the time of building permit/occupancy. "So kind of a win-win. He didn't have to front the money," Ty said.
Council members confirmed the arrangement and asked about timing and cost escalation; staff said the lien records the city's actual installed cost at the time it was built and that there is no escalator. Gary noted the agreements will appear on title reports and that successors or purchasers of the parcels will also be subject to the lien. Each agreement was considered and approved individually: Resolution 26-24 (Property B, parcel 00-0094-0312), Resolution 26-25 (Property A, parcel 00-0094-0318) and Resolution 26-26 (Property C, parcel 00-0093-5659). Motions to adopt the resolutions were made and seconded and each passed by voice vote.
The transcript contains inconsistent references to the property owner: staff read the name in the agenda as "Doug Buys Utah Homes" and at one point referred to "Doug Woodcliffe owns all three properties." The minutes and final title work should be consulted for the formal legal owner name. Staff said the liens will be discharged when the owner pays the recorded amounts as part of the building-permit process and that building permits/occupancy will not be released until repayment.
Council recorded the resolutions as 26-24, 26-25 and 26-26 and authorized the mayor to execute the agreements; no amendment to the city budget was recorded at the meeting.
