The Leadville City Council voted to authorize a settlement and to empower the city administrator to execute an agreement resolving litigation brought by property owner WDI, the lessor for Family Dollar, about a sidewalk constructed adjacent to State Highway 24 in CDOT right‑of‑way.
City staff explained the dispute arose after the city installed a sidewalk segment on right‑of‑way next to the Family Dollar site; WDI filed litigation in 2023 challenging access and the installation. The resolution authorizes settlement and releases the city from related past and future claims concerning the sidewalk installation. Lori Simons, the city administrator, told the council that there are no fiscal impacts to the city because the city’s insurance carrier will cover the settlement costs.
Council voted to adopt the resolution and to authorize the city administrator to sign the settlement documents. City attorneys were present during the discussion and advised council on legal implications and the coverage by the insurer.
