BZA approves variance for Sandalview Drive homeowner to add conditioned rear room

The City of Huber Heights Board of Zoning Appeals unanimously approved a variance June 3 allowing homeowner Gregory Veigl to construct a conditioned rear-room addition at 7049 Sandalview Drive that would reduce the rear-yard setback from the required 40 feet to 32 feet.
Don Millard, the city’s Code Enforcement Administrator, told the board the property is in an R-4 district where Section 1147.04 of the zoning code requires a minimum 40-foot rear-yard setback. Millard said the existing enclosed patio is classified as a "projection" and therefore has no setback requirement, but because the addition is intended for year-round, conditioned use it qualifies as an addition to the house and requires a variance.
City staff recommended granting the variance, and staff reported that adjacent property owners had been notified and that no objections were received. The applicant, Gregory Veigl, was present and described his reasons for the addition on the record.
Mr. Schaeffer moved to approve the variance request; Ms. Ballard seconded. Roll call showed yeas from Ms. Ballard, Mr. Mach, Mr. Deam, Mr. Schaeffer and Chair Eva Newby; nays — none. The motion carried 5-0.
The board recorded no additional conditions on the variance. The meeting adjourned at approximately 6:22 p.m.; the board noted upcoming meetings on July 1 and Aug. 5, 2026.
