Planning commission finds Tate Avenue property disposition consistent with Los Gatos General Plan

The Planning Commission on June 15 adopted a draft resolution finding that the proposed disposition of town‑owned property at 4 Tate Avenue is consistent with the Town of Los Gatos 2040 General Plan, a procedural step required by California Government Code Section 65402.
Planner Shawn Mullins (staff) told commissioners the property has long been town‑owned and is now in contract for sale. Government Code Section 65402 requires the planning agency to report on the acquisition or disposal of real property with respect to conformity with the adopted general plan; staff recommended that the commission make the required finding citing applicable housing element goals and policies (H1.7 and H4.5).
Vice Chair Barnett moved to adopt the staff recommendation; Commissioner Bernett seconded. The motion passed unanimously on the record. Commissioners asked whether a close of escrow had an established date; staff said council would consider the purchase and sale agreement at an upcoming meeting and that a close of escrow was likely to be approximately 30 days after council action, placing proceeds in the next fiscal year’s budget rather than the current one.
Next steps: Council consideration of the purchase and sale agreement and anticipated escrow closing; staff will proceed consistent with the commission’s conformity finding.
