Board approves stormwater maintenance agreement for Hawks Landing Condominiums

The Board of Public Works approved a stormwater maintenance agreement on May 7 that places responsibility on St. Paul Rental Properties and Hawks Landing Condominium owners to construct, inspect and maintain stormwater Best Management Practices (BMPs) and to report annual inspections to the city.
Staff explained the agreement requires property owners to perform annual inspections and submit reports; the city is developing a software portal to manage submittals and reminders from owners. "There are specific reporting requirements back to us to make sure that they are maintaining their facilities," Brandon said, and staff noted the city can use chapter 32 ordinance provisions to enforce compliance if owners do not meet requirements.
Board members confirmed inspection checklists will be used and staff said each BMP type has specific items to inspect depending on the facility design. Kevin Riley moved to accept the Hawks Landing maintenance agreement; the board approved it unanimously.
Staff said the agreement is similar to past maintenance agreements and will be managed through the city's forthcoming compliance software; enforcement will include citation options under the city's stormwater ordinances if needed.
