Dare County rejects lowest groin-repair bid, awards contract to SJ Hamill Construction

The Dare County Board of Commissioners on June 15 voted to reject the lowest bid for a groin construction and repair project as nonresponsible and to award the work to SJ Hamill Construction.
The county manager told the board staff had discussed timing and performance concerns with the low bidder and recommended rejecting that bid and moving to the second-lowest bid to avoid a delay of roughly two weeks. “Since the contractor agrees with us, then we're gonna reject his bid and move the 2nd bid, which will save us probably 2 weeks,” the county manager said. The manager estimated the contract would be about $8.6 million and said funding is available to cover the award.
Commissioners confirmed the second bidder was SJ Hamill Construction. A commissioner said the county had “confirmed, vetted” the company and that “they're bona fides. They're legit. They can do this.”
A motion to declare TD Yuri Marine Construction nonresponsible and reject its bid was moved by Commissioner Mary Ellen Balmes and seconded; the board approved the motion by voice vote. The board then approved a motion to award the contract to SJ Hamill Construction and authorized staff to execute the documents to finalize the award; that motion also passed by voice vote.
Board members and staff emphasized the schedule is weather-dependent. County staff said SJ Hamill is a larger contractor that will mobilize earlier and, absent weather delays, is expected to complete the 450-foot bid requirement by December.
The county manager placed the rationale on the public record, saying the rejection was based on the bidder’s inability to timely perform the contract. The board directed staff to proceed with contract execution and any necessary budget amendments.
The board did not record a roll-call tally in the transcript; motions were carried by voice vote.
