Senate approves ballot referral that would constrain diversity and equity programming

The Senate voted to refer HCR 2,044 to the ballot after extended floor debate. Sponsors described the measure as a check on preferential policies and an effort to enshrine limits on race‑ and identity‑based preferences in the constitution; opponents across the aisle said federal and existing state law already prohibit discrimination and warned that the referral would restrict programs, chilling grants and diversity initiatives at state agencies, universities and school districts.

Senator Ortiz said the referral grew out of broader culture‑war contests and would have a negative impact on communities of color and historically marginalized groups. Opponents also warned the proposal could make the state ineligible for some federal grants, reduce resources for student supports and restrict discussion of historical topics in schools. Proponents argued the measure restores uniform protections and prevents what they termed “preferential treatment” in public contracting and education. The measure passed on final reading and the secretary instructed transmittal to the House for the ballot process.
