The Senate voted to send HCR 2,003 to the ballot after heated floor debate and a failed floor amendment intended to narrow the referral. Senator Lisa Ortiz argued her amendment would preserve fairness by prohibiting someone actively participating on a boys' team from also competing on a girls' team and by requiring athletic bodies to adopt inclusion rules based on athletic ability relevant to the sport. "My amendment gets to that point by simply allowing but not requiring schools and athletic associations to designate interscholastic or intramural teams… and it prohibits athletes currently participating in sports for boys from also participating in a sport designated for girls," Ortiz said while urging colleagues to support the amendment.
Opponents said the amendment gutted the referral's purpose and that the measure as drafted is needed to protect women's competitive opportunities. Committee and floor debate included repeated references to Title IX and whether the referral would apply to private athletic associations as well as public schools. The Ortiz floor amendment failed on a division (11 ayes, 16 nays). On final reading the referral passed and was recorded for transmittal to the House.
