PSC advances encroachment review, flags indemnification rewrite and other policy work-plan items

The Wellesley Select Board Policy Subcommittee on Feb. 26 updated its FY26 work plan and moved several draft policies toward additional review.
Mr. Largess reported that the Department of Public Works and the Natural Resources Commission have reviewed and signed off on the encroachment policy; he will confirm whether the Board of Public Works formally voted on adoption and update the document with adoption dates as appropriate. The Subcommittee plans to present the encroachment policy to the Municipal Light Board, School Committee, Board of Library Trustees and other relevant bodies as part of a broader outreach "roadshow." Town Counsel Tom Harrington cautioned that the draft should address adverse-possession risks for Town land.
On indemnification, members noted the existing policy is outdated. Mr. Harrington advised against rescinding the indemnification policy without a replacement and will provide a legal memorandum addressing insurance and legal considerations; Mr. Largess will work with Town Counsel on a memorandum to the Select Board.
Ms. Aufranc will lead development of a capital policy and plans to meet with the Executive Director and finance staff to discuss guidance on a debt stabilization fund. Mr. Harrington said he would share Littleton’s "Abutter’s Lot Sale Program" as a model for a Sale of Town Land policy; Ms. Aufranc will draft that policy. Ms. Aufranc will also consult with the Executive Director on draft language for denying permits to applicants with unpaid taxes. Mr. Largess will review the Building Use Policy and Code of Conduct to determine the scope of revisions.
The Subcommittee set its next meeting for April 16, 2026, at 11:00 a.m. and adjourned at noon.
