Upper Hanover Township supervisors voted to approve a set of developer and stormwater agreements and to authorize release of final plans for the Kraussdale Road Industrial Project, subject to a package of required contributions and posted securities.
The actions, taken Nov. 11, 2025, approve the developer's agreement with 5G PA Realty, LLC and a separate Stormwater Controls & BMP Operation and Maintenance Agreement. Each motion passed 4‑0‑1, with Chairperson Steven Rothenberger recusing and abstaining from the votes.
The Board authorized Township Manager Anne W. Klepfer to release the final plans for recording with the Montgomery County Recorder of Deeds once several conditions are met. Those conditions listed by the Board include: signed and sealed plans in compliance with the Recorder's requirements; fully executed easements for off‑site stormwater facilities to be recorded with the plans; funding a legal/engineering escrow in the amount of $10,000; a $40,000 contribution for improvements at Schoolhouse Road and State Route 663; a $10,000 contribution to the Township BMP Fund under §415‑38 of the Stormwater Management Ordinance; financial security totaling $2,118,742.56 for on‑site and off‑site public improvements (exclusive of Phase 1 road widening); and financial security of $563,000 for Phase 1 road widening improvements.
Board members who voted in favor included Ben Fiorito, Stefan Laessig, Dottie Diehl and Tim Woodward. The motions were moved and seconded from the dais; record motions and seconders were recorded during the meeting.
Why it matters: the conditions combine engineering, financial and off‑site improvement commitments intended to ensure the project funds stormwater mitigation, intersection improvements and that construction obligations are secured before plan recording. The recusal by the chair left four supervisors to act on matters directly affecting the Kraussdale project.
What happens next: Manager Klepfer will release plans for recording only after the applicant satisfies the listed conditions. The Board recorded the required motions and votes; no additional public hearing on the developer agreements was recorded during this meeting.
"The applicant shall provide signed and sealed plans in compliance with the requirements of the Recorder of Deeds Office," the Board required as part of the recording conditions, and it recorded the specific financial contributions and securities noted above.
The Board's action preserves the Township's checklist for plan recording and ensures that off‑site stormwater easements and financial securities are in place before the Recorder files the final plans.
