Council voted Tuesday to conditionally approve a special‑use permit allowing Heichal Hakadosh Synagogue to operate at 4521 University Parkway, with several state and safety conditions attached.
Vice Mayor Michele Weiss moved to accept the Planning Commission's recommendation, and Councilwoman Threse Marshall seconded. The motion, which Council approved on a roll call vote, passed six to one; Councilman Christopher Cooney voted no.
The approval is contingent on state plan‑review and building‑code compliance. City staff and the applicants said they are working through nine items flagged by the State plans examiner, including changes to accessible parking dimensions and confirmation that required exit doors swing outward. Applicant representatives Ari Jaffe and Rich Bosick said they were addressing those items and that a walkthrough inspection would follow.
Council and staff also discussed parking and emergency access. The Planning Commission had recommended variances reducing required parking from 60 spaces to 22 on the property; applicants told Council the site contains 22 on‑site spaces and said there are additional, informal overflow arrangements with nearby homeowners. Several council members raised concerns that those private arrangements could overlap with earlier allocations to another congregation, Aleksander Shul, and asked the administration and the Law Director to check for conflicts. Law Director Michael Cicero advised that if material differences exist between what Planning Commission approved and the site as finally configured, Council could refer the matter back to Planning Commission for further review.
Fire Chief Bob Perko and Building Official Bill Bartley noted the property had a newly installed fire‑alarm system and that the Fire Prevention Office would complete a formal review. Council amended the conditional approval to allow the number of on‑site parking spaces to be reduced to 17 if the Fire Department determined a fire lane must be designated, and otherwise leave the Applicant's 22 on‑site spaces intact.
The permit is for use in a U‑1 residential zone and explicitly requires the applicants to resolve all State review comments and obtain any necessary building‑code approvals before full occupancy for larger events. The motion and conditions were recorded in the meeting minutes and will be enforced through the city's normal permit and inspection processes.
Council recorded the action as a conditional land‑use approval; follow‑up inspections and any required site adjustments will be completed during the building plan‑review process.
