Council discusses sale of former Barr’s Gas Station parcel; solicitor flags deed and environmental restrictions

West Union — The Village Council discussed offering two parcels associated with the former Barr’s Gas Station and the old water-tower site for sale Tuesday, but the solicitor cautioned the parcels carry restrictive deed and environmental limitations that could limit excavation and redevelopment.
Solicitor Tom Mayes said the properties "have giant deed restrictions" and that the restrictions will "have to go with it" when the land is sold; he told the council he would revise the draft ordinance to change a name on the deed, attach the deed restrictions to sale notices and determine whether the law requires publishing notice in the newspaper or allows alternate notice procedures. Council agreed there was no objection to preparing the materials and indicated it would consider the ordinance as a first reading at the next meeting.
Mayor Jason Buda and council members asked whether publication in the paper was required and whether the process could avoid a lengthy advertising window; Mayes said he would research the current rules and return with options. No sale or formal acceptance of bids occurred at the meeting. The council directed the solicitor and staff to prepare the ordinance and supporting documents so the item can move to a formal vote at a subsequent session.
