The Vienna City Council approved a resolution authorizing a temporary storage, staging and construction laydown lease with Pop Gas Inc., to permit pipeline-replacement work on city-owned property.
Under the approved terms discussed at the meeting, the lease provides an initial six-month primary term with renewal provisions and consideration of $2,500 for the primary term (and $2,500 for each renewal term). Council members noted a contractual maximum of 18 months for the arrangement.
Council added an amendment to the draft lease requiring tenants to prevent the tracking of mud, dirt, stone, gravel or other debris onto public and private roads and to promptly clean any trackout. The amendment allows the city to perform cleanup and seek reimbursement from the tenant should the tenant fail to comply; repeated failures would be considered default under the lease. The amendment passed by voice vote before the council approved the amended resolution.
