Upton Select Board declines right of first refusal on East Street lot, approves donations and trust funding

The Upton Select Board voted on multiple town actions at its Feb. 17, 2026 meeting, including declining the town's Right of First Refusal on an East Street parcel and approving donations and trust-funded allocations.
The board declined to exercise the town's statutory Right of First Refusal under Chapter 61A for a 2.23-acre lot on East Street (Map 017, Lot 011). Chair Laura Hebb recused from that discussion; Member Brett Simas led the item and, after deliberation, Members Maureen Dwinnell and Brett Simas voted in favor of declining the right. The motion (by Member Dwinnell, seconded by Member Simas) carried; Hebb did not participate in the vote.
The board accepted a $1,500 donation from the Saint Gabriel Knights of Columbus to support Elder and Social Services under Massachusetts General Laws Chapter 44, Section 53A. The motion was made, seconded and passed unanimously.
Members approved a $3,000 FUSe funding request from the William Knowlton Trust Fund to help underwrite Senior Center events and authorized the Town Manager and Finance Director to process the related expenditures. The motion (moved by Member Brett Simas and seconded) passed unanimously.
The board also expressed support for accepting approximately 2.3 acres offered by Peter and Penny Adams, contingent on a satisfactory title search. The motion (by Member Simas, seconded by Member Dwinnell) passed unanimously.
Separately, the board accepted the resignation of Stephen Capuzziello from the Cemetery Commission and thanked him for his service. That motion (by Member Dwinnell, seconded by Member Simas) passed unanimously.
