Smyth County BZA approves side-yard variance for Teapot Lane property; refunds church application fee

The Smyth County Board of Zoning Appeals approved a side-yard variance for a Teapot Lane property and refunded a church’s application fee at its April 3, 2018 meeting at the Smyth County Office Building.
Cameron Wolfe represented property owner Christopher Galliot in a request to add a deck, a screened porch and a walkway at 2228 Teapot Lane. Wolfe told the board the proposed walkway would be about 2 feet 8 inches from the lot line and the porch about 7 feet 4 inches from the lot line, and that the owner sought relief from the 15-foot side-lot setback. Board member John DeBusk III moved to approve the variance “as presented”; Newell Johnson seconded the motion and the board carried it unanimously.
The approval permits the owner to construct the porch and deck as described in the application; the board determined the narrow walkway did not require separate approval under its setback rules.
Separately, the board reviewed an application from Blessed Hope Baptist Church at 2559 Highway 16 that sought a front-setback variance. County staff cited §3-2.4 on how setback distances are measured — to the nearest point of a building or structure, excluding unenclosed porches, stoops, decks and patios — and concluded the church’s application did not require a variance. Following that determination the application fee of $250 was refunded to Blessed Hope Baptist Church.
The board closed the public hearing at approximately 6:09 p.m. and approved the January 9, 2018 minutes before adjourning at about 6:13 p.m.
