The Fremont City Council on April 14 voted 8–0 to authorize the mayor to execute a non-disclosure agreement (NDA) at the request of the U.S. Chemical Safety and Hazard Investigation Board (CSB), which is conducting an investigation of the Horizon Biofuels incident.
City Attorney Travis J. Ketts described the NDA as covering confidential business information, security information and related materials that the CSB may request in its investigation. Ketts offered that if councilors had detailed legal questions they could move to executive session, but staff recommended approval and offered to answer questions on the public record.
Councilman Peterson moved approval of Resolution 2026-098; Councilman Jensen seconded the motion and it passed 8–0.
What happens next: The mayor is authorized to sign the NDA and staff may provide confidential materials to the CSB under the agreement; any substantive legal issues or executive-session matters would be handled separately as needed.
