Valley View council denies appeal on variance at 6719 Canal Road
Summary
Council voted 5-0 to deny an appeal of the planning commission's variance decision for 6719 Canal Road after testimony from a nearby resident and sworn testimony from building staff confirming the property is in the flood plain and that a prior 2022 FEMA-related elevation plan proved infeasible.

The Village of Valley View council on Feb. 11 denied an appeal of a planning commission variance decision for a property at 6719 Canal Road, voting 5-0.
Michael Shaw of 6713 Canal Road was sworn in and read a written statement during the appeal hearing. Shaw and council members discussed distances between property lines and the corner of the proposed addition. Building Commissioner Ellis, sworn in to give testimony, said the property is in the flood plain. Law Director Lambros and Ellis explained the variance had been considered previously in 2022 as part of a FEMA elevation plan, but the elevation project was not completed because the bid to raise the house proved infeasible.
Councilman Spieth summarized the legal meaning of a variance as a waiver from specific development standards rather than a change in zoning. After questions and testimony, the council moved to deny the appeal of the planning commission decision; roll call recorded AYE: 5 / NAY: 0.
The denial means the planning commission's approval (or denial as applicable) stands and the council did not overturn that decision. The council did not specify further remedies or next steps for the property owner in the meeting record.
