Charter authorizers approve Alpine amendment, agree to release counsel'prepared crosswalk

The Wyoming Charter School Authorizing Board voted unanimously Feb. 18 to approve an amendment to the Alpine Charter School contract and to release the attorney-prepared crosswalk document explaining how the contract addresses board concerns.

Board Chair Janine Beski opened the continued discussion and invited board counsel McKenzie Williams to brief members on a crosswalk that maps raised questions to contract provisions. "The crosswalk I provided more or less speaks for itself," Williams said, noting he had provided the document to board members and did not alter his assessments since the prior day's discussion.

Why it matters: the board debated whether earlier community concerns stemmed from a now-abandoned unified-governance proposal rather than from the education-service-provider model before them. Alan Bus moved, and members agreed as a friendly amendment, to approve the Alpine contract amendment incorporating counsel'recommended revisions, specifically substituting "CMO" with "ESP" to align with Wyoming statute. After discussion, the board adopted the motion by roll call.

Supporters said the community had worked to refine Alpine's governance and operations. Committee member Fred said the community had come together around a new partnership with Academica, praising the process and saying, "protection is often the enemy of progress." Several other board members compared Alpine's path to prior startup experiences and expressed confidence the amendment set the school up to proceed.

John Masters moved that the counsel-prepared crosswalk be made a public document and attached to the minutes. Board members debated whether to release the document immediately or only with the minutes; they ultimately approved immediate release and to attach it to the minutes. Staff said they would prepare a public version "removing the attorney work product header" before posting.

What the record shows: counsel represented that some earlier concerns arose from the now-abandoned unified-governance concept and are less applicable to the ESP arrangement before the board. McKenzie Williams said he "did not make any changes to any of my assessments or evaluations from yesterday to today," but provided the crosswalk to clarify how prior contract language intersected with the board's concerns.

The meeting minutes will record the motion text, the substitution of CMO with ESP as recommended by counsel, and the unanimous roll-call vote approving the amendment. The board's action also committed staff to preparing a public version of the counsel'prepared crosswalk for immediate release and attachment to the minutes.

Members closed the Alpine item by thanking counsel for the rapid work and expressing ongoing support for the school's start-up activities.
