The board considered an appeal of groundwater-sustainability fees filed by Fred Sagehorn (and Sun, Inc.). Staff explained the fee-appeal process in Resolution 24-05 and said the general manager had declined to grant the magnitude of relief requested and forwarded the matter to the board for direction.
Staff told members it had double-checked parcel boundaries and that the parcels in question appear to lie within the current GSA footprint. The general manager said one APN listed by the appellant (1872502000) may have been omitted from the consultant's roll and could produce a small additional fee. "We definitely don't intend to charge someone that's not inside the footprint," staff said, and recommended verifying the appellant's parcels and following up directly.
Board members agreed staff should verify the acreage within the basin and return with a targeted response rather than commissioning an expensive, basin-wide boundary audit. Director Bailey emphasized that fees should reflect irrigated acreage in the portion of a parcel that lies inside the basin. Staff said the City of Yukaya is preparing an interactive GIS layer that will facilitate spot checks and quicker fact checks while the agency's fee-finder tool is offline.
