The Beachwood Planning & Zoning Commission approved a variance to permit a six-foot solid vinyl privacy fence at 3292 Richmond Road for Baywood Estates Condominium, citing a practical difficulty in enforcing the code’s board-on-board fence standard in this location.
Phil Saroki, Baywood Estates treasurer, told the commission the existing board-on-board cedar fence dates to 1985 and was damaged in a recent storm; he said the association proposes an exact replacement using a tan Hamilton-style vinyl fence with a 25-year finish warranty. "It's an exact replacement of the present fence and gate to the inner courtyard with this material instead of the board on board stained cedar that exists today," Saroki said.
Building and police/fire staff reported no objections; engineering offered no comments. Planning staff noted that the commission may grant a variance under section 1,159.04 and recommended finding a practical difficulty under code section 1,146.029 and permitting the solid vinyl fence to enclose the outdoor patios.
The motion (PZ2024-21) was moved, seconded and approved by roll call. Commissioners recorded affirmative votes and the variance was granted; the applicant may proceed with required permits in accordance with staff and building-department processes.
The commission's approval applies only to the style and height for the stated location; building permits and any necessary inspections remain required.
