Planning commissioner’s reappointment questioned over recurring warehouse zoning concerns

The South Heidelberg Township Board of Supervisors interviewed Mike Davis on Feb. 17 about reappointment to the Planning Commission amid Davis’s repeated concerns over whether township zoning permits proposed warehouse projects.

Davis, whose prior term ended Dec. 31, 2025, told the Board the zoning officer’s on-the-record explanation at the meeting was "the first time the zoning has been explained to me," a comment that prompted Township Manager Sean A. McKee to note staff had previously provided written and oral guidance. "That March 2025 letter included multiple legal counsels’ opinions and the zoning officer’s view," McKee said, referring to a letter distributed to Davis and discussed at public meetings.

Township Vice Chairman John Gerhart told Davis the intent of the discussion was not to prevent questions but to ask whether there were areas for improvement in Davis’s service; Davis did not offer proposed changes. McKee said the Board plans to interview other candidates who have expressed interest and hopes to make a decision within a month or two.

Township Solicitor Andrew George separately reported that improvements agreements related to the CB Warehouse development have been signed and fees submitted; he said the Board’s signature is needed to complete the administrative process. During public comment, Davis asked whether the CB Warehouse approval could be re-opened after it was determined the project is tax-exempt. McKee replied that the plan and its conditions "have already been approved, recorded and agreements are in place based on the approvals," and therefore cannot be revised at this stage.

The Board did not take a final reappointment vote on Davis during the recorded segments; McKee said additional candidate interviews are forthcoming.
