Bentleyville council approves three Planning & Zoning variances including lot consolidation

The Village of Bentleyville Council on Aug. 21 unanimously approved three variances recommended by the Planning & Zoning Commission, clearing the way for a lot consolidation, a front-yard generator installation and a 432-square-foot accessory structure.
Council moved first on a request from Steve Joseph to consolidate three parcels adjacent to his home at 378 Miles Road into a single lot that could accommodate a future single-family house. Attorney Chuck Nemer recounted that Planning & Zoning had recommended approval; Councilmember Robert Chalfant and others confirmed the property is zoned residential and had no objections. The motion to approve the lot consolidation was moved by Ryan Rubin and seconded by Lisa Whitmyer and passed on a roll call vote (Chalfant, Rubin, Whitmyer, Hemmelgarn, Goetsch, Kvacek: yes).
Also before the council was a request from Mr. and Mrs. Spaeth at 35974 Solon Road for a variance to place a generator in the front yard, waiving Chapter 1460’s requirement that generators be in side or rear yards. Mr. Nemer said the Planning & Zoning Commission approved the variance after reviewing plans showing landscaping and siting intended to screen the unit from the street; Mr. Spaeth said the gas line is already installed. The motion was moved by Rubin, seconded by Whitmyer and passed unanimously.
A third variance approved would allow Earle and Michelle Rogoff to construct a 432-square-foot accessory storage building at 6367 Chagrin River Road to house horse and agricultural equipment. The Rogoffs told council the structure is prefab, will be placed adjacent to an existing barn so it will read visually as part of the barn, and will be roughly 45 feet from one side yard and 12 feet from the other. Planning & Zoning had unanimously recommended approval. The motion, moved by Rubin and seconded by Whitmyer, passed on a unanimous roll call.
Each of the three items came to council after Planning & Zoning review and was approved without recorded dissent. Several council members asked clarifying questions about siting, foundation and visibility before voting.
The council did not set additional conditions beyond those reviewed by Planning & Zoning. The council will record the approved variances in village records and the applicants may proceed with permitting steps as required by village code.
