Planning Board recommends council clarify pool-enclosure rule in Codified Ordinance 1462.03

Building Commissioner Larry Ellis explained the revision would explicitly state that above-ground pools with sides greater than four feet above grade need not have additional fencing or barriers. Solicitor David Lambros told the board he believes the current ordinance already conveys that meaning and that the proposed change is intended to clarify the language.
The board approved sending the recommendation to council (motion by Mike Bertovich, second by Marty Johnston) on a roll-call vote. Ayes were March, Spieth, Johnston, White and Bertovich.
The clarification is intended to reduce ambiguity in permit review and enforcement; Solicitor Lambros and Mr. Ellis said they would prepare the language and follow the council submittal schedule. The meeting record does not include the final ordinance text or an effective date; the board's action was limited to forwarding a recommendation to Village Council.
