Planning board approves six-inch setback variance after resident replaced deck without permit

Mark Whitlock, a resident of 9858 Gleeson Drive, told the Village of Valley View Planning Board on March 3 that he had rebuilt a deck after determining the old structure could not be salvaged. Whitlock said he ordered materials and constructed the deck thinking it was a routine repair and later learned from Building Commissioner Larry Ellis that the new deck likely exceeded the side-yard setback and required a variance.
Whitlock said his neighbor is agreeable to the variance request. Board members asked no additional questions and moved to approve the variance for a six-inch side-yard building setback (Variance from Ordinance Section 1248.05(b)). Member Mike Bertovich moved the motion; Member Joseph White seconded it; the motion passed on roll call.
The board’s action regularized the rebuilt deck by granting the setback variance; any necessary building permits, inspections or corrective measures will be handled through the Building Department.
The board adjourned at 5:17 p.m. following the vote.
