Trustee Teets presents ordinance to vacate alley after strip mall encroachment

Trustee Loretta J. Teets presented Ordinance 25-15, proposing to vacate portions of the north–south public alley east of the properties commonly known as 1501 and 1505 North Mannheim Road and said the corresponding plat of survey was included in the board packet.

Mayor Beniamino Mazzulla explained the issue dated back several years when construction of the current strip mall resulted in roughly 18–20 feet of the structure encroaching into the public alley. He said a portion of that area legally belongs to the Village of Stone Park and that the property owner, Kambiz Shirazi, covered all legal and survey expenses required to resolve the encroachment and correct the plat of survey to prevent future legal complications.

If approved in a future action, vacating the alley would transfer the village’s interest in the specified portion of the alley and resolve the encroachment recorded in the plat of survey.
