The Select Board was updated that a court affirmed the code officer’s (CEO) notice of violation related to a property on Mountain Road (277). Staff reported they are preparing a land-use complaint to file in superior court to secure enforcement measures, which could include fines or orders to remedy or remove the offending structure; the precise remedies and any timeline will be set by the court.
The manager said the town’s attorney is drafting the complaint and will forward it to town staff for review. The board also received a status update on a separate property (83 West Main), where town staff await the judge’s ruling on a demolition filing.
Board members asked for copies of the attorney’s draft complaint when available and requested staff track next steps for possible enforcement and collection of costs if the court rules in the town’s favor.
